1. Introduction

Shaanti is a consumer wellness platform owned and operated by Ananta Shakti LLC, a California limited liability company (“Ananta Shakti,” “we,” “us,” or “our”). Shaanti provides educational content grounded in Ayurveda and offers personalized guidance through AI-driven assessments and tools (the “Platform”). These Terms and Conditions (“Terms”) govern your access to and use of the Platform, including any content, features, products, services, or subscriptions offered through Shaanti.

2. User Agreement

By accessing or using the Platform, creating an account, or proceeding through checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy below. If you do not agree, do not use the Platform.

3. Educational Content Disclaimer; No Medical Advice

All content on the Platform, including AI-generated insights, assessments, recommendations, product curation, and ritual suggestions, is provided for informational and educational purposes only and is not medical advice, diagnosis, or treatment. The Platform does not create a patient–provider relationship. The Platform is not a covered entity or business associate under HIPAA. Do not upload protected health information unless you consent to our handling it as described in the Privacy Policy below. Always seek the advice of a qualified healthcare professional with questions regarding a medical condition, and never disregard professional medical advice or delay seeking it because of information on the Platform. If you believe you have a medical emergency, call your doctor or emergency services immediately.

4. Eligibility and Accounts

You must be at least 18 years old to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information and to notify us of any unauthorized use of your account.

5. Data Collection and Communications

• Information We Collect: We collect your first name and email address to create or manage your account, to deliver personalized assessments and reports, and to communicate with you about the Platform. Additional information you choose to provide in assessments may be used to generate personalized guidance.
• Communications: By providing your email, you consent to receive transactional emails (e.g., assessment results, account notices, subscription confirmations). You may opt out of non-transactional marketing emails at any time via unsubscribe links or by contacting us at [hello@findshaanti.com].
• Privacy: Our data practices are described in our Privacy Policy [link to Privacy Policy], which is incorporated by reference into these Terms.

6. Assessments and AI Guidance

The Platform may prompt you to complete questionnaires or assessments to help identify your unique constitution (e.g., Ayurvedic doshic profile) and wellness preferences. Based on your inputs, our AI may generate personalized guidance, educational content, curated product suggestions, rituals, and event recommendations. AI outputs depend on the quality and completeness of your inputs and are provided “as is” for educational purposes (see Section 3). You are solely responsible for how you use this information.

7. Subscription Model; Free Trial; Billing; Cancellation

• Free Trial: We may offer a free trial for a limited period to new users (“Free Trial”). Eligibility, duration, and included features are described at checkout and/or on the applicable offer page. We reserve the right to modify or revoke Free Trials at any time.
• Premium Member Subscription: After any Free Trial, access to Premium features requires an active paid subscription (“Premium Membership”). Subscription fees, billing intervals, and included features are disclosed at checkout.
• Billing: By starting a Premium Membership, you authorize us (and our third-party payment processor) to charge the subscription fee and applicable taxes to your payment method on a recurring basis until you cancel. If a charge is not successful, we may suspend or terminate access until payment is received.
• Cancellation: You may cancel your Premium Membership at any time, effective at the end of your current billing period, by following the in-account cancellation process or contacting [hello@findshaanti.com]. We do not offer refunds or credits for partial billing periods, except where required by law or as stated at checkout. Upon cancellation, you will retain Premium access through the end of the then-current paid period.

8. Commerce and Curation

The Platform may present personalized recommendations for wellness products, rituals, programs, classes, and events, including third-party offerings (collectively, “Curated Offerings”).

• No Endorsement or Warranty: Recommendations are generated based on your inputs and our curation criteria. We do not manufacture or control third-party products or services and do not guarantee their quality, safety, efficacy, availability, or regulatory compliance.
• Third-Party Terms: If you purchase third-party products or services, your purchase and use may be subject to the third party’s terms, privacy policies, and warranties. You are responsible for reviewing those terms.
• Availability and Pricing: Availability, descriptions, and pricing of Curated Offerings are subject to change without notice. We reserve the right to correct errors or omissions.

9. User Conduct

You agree not to:

• Use the Platform for unlawful purposes or in violation of these Terms.
• Provide false, misleading, or incomplete information.
• Reverse engineer, scrape, or attempt to derive source code or models.
• Interfere with the security or integrity of the Platform or other users’ use.
• Upload content that infringes intellectual property or violates rights of others.

10. Intellectual Property

The Platform and all content, features, and functionality (including text, graphics, logos, AI outputs, and software) are owned by Ananta Shakti or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or publicly display the Platform or its content except as expressly permitted by these Terms.

11. Feedback

If you submit feedback, ideas, or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, and exploit such feedback without restriction or compensation, subject to our Privacy Policy.

12. Limitation of Liability; Disclaimer of Warranties

• Disclaimer: The Platform, including AI guidance and Curated Offerings information, is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, quiet enjoyment, non-infringement, or that the Platform will be uninterrupted, timely, secure, or error-free.
• Limitation of Liability: To the maximum extent permitted by law, Ananta Shakti LLC and its owners, officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Platform or Curated Offerings, even if advised of the possibility of such damages. To the extent any liability is found, our aggregate liability for all claims arising out of or relating to the Platform will not exceed the greater of: (a) the amounts you paid to us for the Premium Membership in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100.
• Essential Basis: The foregoing limitations form an essential basis of the bargain between you and us.

Some jurisdictions do not allow certain disclaimers or limitations; in such cases, they apply to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ananta Shakti LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

14. Choice of Law; Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of laws principles. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a “Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act (FAA). The arbitrator, not any court, shall have exclusive authority to decide all issues of arbitrability and the interpretation, applicability, and enforceability of this provision. Unless you choose an in-person hearing in the county of your residence, the arbitration may be conducted by video/telephone. Class, collective, consolidated, private-attorney-general, and representative actions are not permitted; the arbitrator may award relief only to the individual party seeking relief and only as necessary to resolve that party’s claim. Either party may bring an individual claim in small-claims court instead of arbitration. Judgment on the award may be entered in any court of competent jurisdiction. You may opt out of this arbitration provision within 30 days of first accepting the Terms by emailing hello@findshaanti.com with subject line “Arbitration Opt-Out” and your account email. This section survives termination of the Terms and your use of the Services.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any other lawful reason. Upon termination, Sections intended to survive (including, without limitation, Intellectual Property, Feedback, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous) will survive.

16. Amendments

We may update these Terms from time to time. If we make material changes, we will provide notice by email to the address associated with your account and/or by posting an in-product notice, and we will update the “Effective Date” above. Changes will be effective on the date stated in the notice. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

17. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and any applicable subscription or checkout terms presented to you, constitute the entire agreement between you and us regarding the Platform.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
